I. General Provisions
These terms and conditions govern the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase agreement (hereinafter referred to as the "purchase agreement") concluded between the seller and another natural or legal person (hereinafter referred to as the "buyer") through the seller's online store at www.teplickedorty.cz.
The terms and conditions apply to persons ordering goods in the course of their business activities.
Deviating provisions from the terms and conditions may be agreed in the purchase agreement. Deviating agreements in the purchase agreement take precedence over the provisions of these terms and conditions. The wording of the terms and conditions may be amended or supplemented by the seller.
By placing a binding order, the buyer confirms that they agree to conclude a distance purchase agreement and at the same time accepts the terms and conditions for the delivery of goods declared by the seller. The relationship between the buyer and the seller is governed by these terms and conditions, which are binding on both parties.
The rights and obligations of the participants in the purchase agreement are governed by the valid Civil Code.
II. User Account
Upon registration, the buyer will be issued access credentials, which will be used to log in to the customer section. Access to the user account is secured by a username and password. The buyer is required to maintain confidentiality regarding the information necessary to access their user account and acknowledges that the seller is not liable for any breach of this obligation by the buyer.
The buyer acknowledges that the user account may not be available continuously, especially in view of the necessary maintenance of the seller's hardware and software equipment, or the necessary maintenance of hardware and software equipment of third parties.
III. Subject of the Contract Advance payments by the buyer and determination of the deadline for payment of such advance. The buyer acknowledges that the seller is not obliged to conclude a purchase contract, especially with persons who have previously substantially breached their obligations towards the seller. The buyer agrees to the use of distance communication means when concluding the purchase contract. The costs incurred by the buyer when using distance communication means in connection with the conclusion of the purchase contract shall be borne by the buyer. Any cancellation of an order can be done by email or by phone (see contact section). b) bank transfer - from your account to the seller's account 35-3593640217/0100. Please state the order number as the variable symbol. The buyer's obligation to pay the purchase price is fulfilled at the moment the relevant amount is credited to the seller's account.
The subjectContracts are goods specified in the purchase contract - order, the description and parameters of which are stated directly on the website or are specified in the packaging leaflet. The dimensions, weight, capacity and other details stated on www.teplickedorty.cz, in catalogs, brochures and other printed materials are based on data from manufacturers, with the manufacturer reserving the right to make technical changes to the product without prior notice. All information is provided based on the current available data from suppliers. The buyer has the right to ask by email before ordering the goods to verify the information. The pictures of the products are for illustrative purposes only. Actual products may differ in some details - e.g. differences in color scheme - in such cases, the product description where the color or content of the set of products is detailed is decisive. The seller undertakes to deliver only goods in perfect condition to its customers and in accordance with specifications or features common for the given type of goods complying with the relevant standards.
IV. Conclusion of the purchase contract
This provision does not limit the seller's ability to conclude a purchase contract under individually agreed conditions. All offers of goods placed in the web interface of the store are non-binding, and the seller is not obliged to conclude a purchase contract regarding this goods. To order goods, the buyer fills in an order form, which includes information about: the ordered goods and the method of payment of the purchase price of the goods.
Before sending the order to the seller, the buyer is allowed to check and change the data entered into the order, including the possibility for the buyer to identify and correct errors that occurred when entering data into the order.
The seller shall immediately confirm receipt of the order to the buyer by email, to the email address provided by the buyer in the order. The seller is always entitled, depending on the nature of the order, to request the buyer for additional confirmation of the order and verification of the information contained therein in a suitable manner such as in writing or by phone. The seller is entitled not to accept an order if the authorization requested by the buyer is refused. The seller also reserves the right to cancel the order in case of a pricing error.
The contractual relationship between the seller and the buyer arises upon delivery of the acceptance of the order, which is sent by the seller to the buyer by email to the buyer's email address.
In individual cases, especially in more costly cases, the seller reserves the right to make the performance conditional on the payment of the final.
V. Place of Performance
The place of performance is the seller's warehouse, where the seller hands over the goods to the carrier - transport company for delivery to the customer, or it is the place of personal pickup.
VI. Price and Payment
The prices of the offered goods are stated without VAT. The offer of selling goods and the prices of these goods remain valid as long as they are displayed in the web interface of the store.
The prices stated on the website of the online store of Studio NET s.r.o. are binding at the moment of the contract conclusion and throughout the duration of a properly concluded contractual relationship. Studio NET s.r.o. reserves the right to change the prices indicated in case of currency exchange rate changes, significant inflation, or significant changes in supply conditions of manufacturers and other suppliers of goods. The purchase price will be considered paid only after the entire purchase price is credited as a separate part of the delivery to the seller's account or upon payment of the entire amount in cash to the carrier's employee. The invoice issued based on the purchase contract between the seller and the buyer also serves as a tax document and delivery note. The buyer can take over the goods fundamentally only after their full payment unless agreed otherwise.
In the event the buyer makes a payment in advance and the seller is unable to ensure the delivery of the selected goods, the seller will promptly refund the customer in the agreed manner. Promotional prices are valid until stock depletion or further offer updates.
